Assume that you are not satisfied that the Constitution protects a right to individual privacy and that you are convinced a “twenty-eighth amendment” needs to be written to protect such a right. If you were to draft such an amendment that would explicitly protect the right to privacy, how would you define the right to privacy? What activities would you include within this right if you were to draft such an amendment? Are there cases on point that support your definition and the activities that you believe should be included?
